In the formation of the acquis of the science of fiqh, many scientific figures have been associated with the methods of the Imams of the sect and their views, which are passed on to the next generations. In the history of the Ḥanafī mad̲h̲hab, there are many scholars whose works, views or just their names have survived. The views of the scholars who are at the forefront of this work can be accessed through their works. The opinions of some scholars (...) who did not have works, or whose works have not survived, can be found in the jurisprudential corpus of other scholars. Unfortunately, there are many scholars whose works and opinions have not survived, and only their names are mentioned. This study focuses on the Ḥanafī jurist al-Baqqālī (d. 452/1060), whose scholarly personality, position in jurisprudence and works have not survived to the present day, although his name is mentioned in fiqh literature. The article analyses various sources and evidence for the identification of al-Baqqālī. The main argument of the article was clarified by examining fiqh books, which are among the authoritative sources of the Ḥanafī fiqh corpus, rather than works of ṭabaḳat, and by scanning digital resources. The determination and presentation of the scholarly personality of al-Baqqālī and his jurisprudential views are the distinctive feature of this article. Baqqālī was recognised as an influential jurist within the Ḥanafī fiqh tradition and was considered one of the mashāʼịḵẖ (eminent jurists). However, detailed information about him could not be found. However, considering the available evidence, it is proven that al-Baqqālī, who stands out with the attribution of al-Baqqālī, is not al-Baqqālī whose views are consulted in the Ḥanafī mad̲h̲hab and among the possibilities that arise, the views that predominate in the identification of al-Baqqālī's identity are given. For this reason, it is emphasised that Baqqālī is a figure that requires further research and study. It is emphasised that this article can contribute to the understanding of the Ḥanafī fiqh tradition. Baqqālī's jurisprudential views on some matters of worship and transaction reflect important debates. Although al-Baqqālī adhered to the basic principles of the Ḥanafī mad̲h̲hab, he occasionally developed original ijtihād against the general views of the imams or the mad̲h̲hab. Baqqālī's original jurisprudence and jurisprudential views occupy an important place in the sect's literature. He was particularly influential in matters of fatwa and left his views to later jurists. Such a study aims to solve a scholarly problem in the fields of the history of science and the history of fiqh. Clarifying the identities and specialisms of those involved can help to ensure historical and scientific clarity. The purpose of this article is to contribute to the accumulation of historical and scientific knowledge by seeking to learn more about this issue and to reduce uncertainties. (shrink)

The work named Fusûlü'l-İmadî, which belongs to Ebü'l-Feth Zeynüddîn el-İmadî, the grandson of Burhaneddin el-Mergînânî, the owner of the famous Hidaye, which includes the subjects of Fürû-i Fiqh and the law of trial, has been one of the main works that has been applied by influencing many mufti, kadi and jurists, especially the Ottoman sheikhs. The work is also important in terms of being a source for many fatawa and fürû-i fiqh works. The fact that the work written in the (...) Fergana region is one of the main sources referenced both in the Ottoman geography and in other Muslim geographies also shows that the work is valuable. In this study, by pointing out the importance and value of the work, it was tried to determine the contribution of the work to the Ottoman period fetâvâ mecmuas and Hanafi fiqh literature. In the study, the life of Ebü'l-Feth Zeynüddîn el-İmadî was mentioned, and his work Fusûlü'l-İmadî was examined in detail. The contribution of the Ottoman Fetvâhâne, which uses Fusûlü'l-İmadî as a source, to some of the fetâva works, which are accepted as one of the most respected fetâva journals, is discussed and some quotations from the work are included with their examples. In addition, the contribution of the work to the Hanafi fiqh literature was examined on the basis of some fürû-i fiqh works of the Ottoman period and the work called Mir'ât-ı Mecelle. Thus, by pointing out the importance of Fusûlü'l-İmadî and his contribution to the literature of fiqh and fatwa, this work was drawn attention to new studies. (shrink)

The Hanafi Sect was the first among the fiqh sects that completed its formation and codification. Abu Hanifa, the founding imam of the sect, raised many students. His most prominent students were Abu Yusuf, Muhammed al-Shaybani and Zufar. While teaching his students, Abu Hanifa created a free environment and was pleased that his students adopted opposing views to his. Accordingly, different views emerged among the imams in question for reasons such as interpreting the texts, taking into account the changes (...) in customs and time, and approaching the issues from different perspectives. After the death of Abu Hanifa, Abu Yusuf served as a kadi, i.e. a judge. Muhammad al-Shaybani played an important role in the formation of the sect. Zakat is one of the subjects where different opinions and disagreements occurred among the imams of the madhhab, or sect. Hanafi books exhibited different approaches in revealing these differences of opinion. For example, there were jurists who mentioned and discussed their differences of opinion in detail, as in Ka-sana’s work Bedai al-sanai fi tertib al-sharai, as well as in Mawsili’s work el-Ihtiyar li-talil al-Muhtar. There were also jurists who took a middle way on the subject. In this study, the differences of opinion of the sect imams Abu Hanifa, Abu Yusuf, Muhammed al-Shaybani and Zufar on zakat will be explained based on the book al-Hidaye by Burhaneddin al-Merginani, which is one of the most popular books of the Hanafi sect. However, the commentaries of al-Hidaye and the books of the sect on fiqh will also be consulted occasionally. In this study, the subjects that are considered more important than the others in regard to the fiqh of zakat will be analyzed. (shrink)

Actualmente, el feminismo, en su condición de movimiento, pero también de teoría viva, fluctuante y sometida a un proceso de revisión, (auto)crítica y disputa permanente, estaría experimentando importantes cambios en el marco de lo que algunas autoras han denominado como cuarta ola. En todo este proceso de emergencia de nuevos feminismos, pero también de pujanza por la categoría y por la significación de la misma, el papel de las políticas e iniciativas públicas —feministas y no feministas— sería de gran relevancia. A lo largo de este trabajo, nos centraremos en analizar algunas propuestas feministas vinculadas a la promoción del empleo y el emprendimiento entre mujeres desarrolladas por el Ayuntamiento de Madrid (2015-2019). De esta manera, analizaremos la producción de sentido y de ideales subjetivos femeninos fomentada en el marco de estas políticas, atendiendo a posibles contradicciones y ambivalencias inherentes a los marcos referenciales movilizados y a su interacción.Currently, the feminist social movement and feminist theories are being subjected to a process of resignification, change and conceptual dispute in the frame of what some authors have called the Fourth Wave. This process involves the theoretical development of new feminist approaches and, thus, the struggle for signifying and owning the category feminism. In this complex process, the role of public initiatives and policies is crucial for setting and promoting the hegemonic meaning of this (and any) category. Throughout this paper, we aim to analyse two feminist initiatives developed by Madrid’s City Council in order to promote employment from an entrepreneurial approach. By doing so, we will be looking into the production of meaning linked to a feminine ideal subject as well as into a gender biased entrepreneurial discourse. (shrink)

Recent developments in information technology and Web services have increased the potential for creating more rapid and extensive social networks and business relationships. Web 2.0 technologies, commonly referred to as online social media, have become important tools within the growth of information and communication technology (ICT) in the last few years. Web 2.0 tools such as blogs, Wiki and other services, which are widely used by individuals, also have an effect on customer relationship management (CRM) systems. Consequently, social CRM (SCRM) (...) is emerging as a new paradigm for integrating social networking in more traditional CRM systems. However, social CRM is yet to be fully utilised as a value-adding tool in improving customer relationships. This paper reports on a scoping study that explored the current situation of CRM adoption in banking industry in Saudi Arabia. The aim of this paper is to identify the factors that may influence businesses and customers’ adoption of social CRM. Various models have been proposed to study ICT and information systems acceptance and usage. This paper proposes an enhancement to one of these models, specifically the Technology Acceptance Model (TAM), by incorporating a range of factors identified in the social networking and business relationships literature believed to influence social CRM adoption. In particular, the model proposes that familiarity, caring behaviour, sharing information and perceived trustworthiness can generate cognitive view about the relationships between employees and customers. El presente artículo pretende evaluar las consecuencias de la tesis de la cognición extendida para la antropología filosófica. Dicha interrogación se enmarca en lo que denominamos el “giro tecnológico” en las ciencias sociales y humanas, un fenómeno relativamente reciente que produce una reorientación en clave posthumanista de la pregunta antropológica. De acuerdo con este giro, la tecnología adquiere una importancia central para la comprensión de lo humano, tanto en su dimensión ontológica como en su presente condición histórica. A su vez (...) este giro tecnológico tiende a rechazar la idea misma de una naturaleza humana ahistórica e inviolable, y postula en su lugar a la figura del “humano distribuido”, íntimamente constituido por su relación con los artefactos y la cultura material. En este contexto, el principal objetivo de este trabajo es rastrear la evolución de la tesis de la cognición extendida a lo largo de cuatro “olas” que marcan su despliegue con el objeto de ofrecer una cierta reinterpretación de esta tesis en el ámbito de la pregunta antropológica. The promotion of conservation agriculture for smallholders in sub-Saharan Africa is subject to ongoing scholarly and public debate regarding the evidence-base and the agenda-setting power of involved stakeholders. We undertake a political analysis of CA in Zambia that combines a qualitative case study of a flagship CA initiative with a quantitative analysis of a nationally representative dataset on agricultural practices. This analysis moves from an investigation of the knowledge politics to a study of how the political agendas of the actors (...) involved are shaping agrarian practices. From its initial focus on CA as soil conservation and sustainable agriculture, the framing of the initiative has evolved to accommodate shifting trends in the policy arena. In tandem with the increased focus on climate adaptation, we see an increased emphasis on private sector-led modernisation. The initiative has shifted its target group from the poorest smallholders to prospective commercial farmers, and has forged connections between its farmer-to-farmer extension network and private input suppliers and service providers. The link between CA and input intensification is reflected in national statistics as a significantly higher usage of herbicides, pesticides and mineral fertilizer on fields under CA tillage compared to other fields. We argue that the environmental and participation agendas are used to buttress CA as an environmentally and socially sustainable agricultural development strategy, while the prevailing practice is the result of a common vision for a private sector-led agricultural development shared between the implementing organisation, the donor and international organisations promoting a new green revolution in Africa. En Carl Schmitt en la Segunda República Española Gabriel Guillén Kalle analiza aspectos particulares de Carl Schmitt en ese periodo de nuestra nación en entreguerras. El autor reconoce que la recepción republicana fue primordialmente jurídica, mas esta perspectiva conlleva observar ese concepto de lo polítíco que atraviesa su obra entera. Guillén propone una estrategia para la relectura de Schmitt en ese periodo y para ello analiza a los principales autores que se ocuparon de él, sin desdeñar a algunos menos conocidos (...) como puede ser Zozaya. Un tema importante para nuestra nación es el control de constitucionalidad que Schmitt, siguiendo a Constant con la teoría del poder moderador, encuentra en el Presidente del Reich, y que en la segunda República española se dejó en un organismo, el Tribunal de Garantías Constitucionales que pretendía colocarse por encima de las pasiones, aunque por su composición -poco jurídica- condujo al fracaso. También es de interés cómo Medina sitúa el pensamiento schmittiano de los órdenes concretos en el idealismo objetivo necesitando de dualismos para su existencia. (shrink)

La Nueva Ola Feminista ha generado dos reacciones que no son nuevas, pero se ven actualizadas por el carácter masivo y global del movimiento: una instrumentalización del feminismo, configurando lo que Laura Martínez-Jiménez denomina “posfeminismo neoliberal”; y una avanzada de un populismo conservador, que redobla su militancia anti-derechos como parte de su programa ante la crisis neoliberal (como puede observarse en el fallo Dobbs vs. Jackson en Estados Unidos). Objetivos. En este artículo analizaremos ambas reacciones (que en algunas ocasiones son (...) leídas como opuestas) como dos caras distintas pero complementarias de la configuración de lo que denomino el corrimiento del histórico género vs. clase a un actualizado género vs. pueblo. Metodología. Dividiremos el artículo en tres apartados: (a) inscribiremos la Nueva Ola Feminista dentro de los movimientos sociales de reacción a la crisis del capitalismo neoliberal; (b) señalaremos los principales clivajes de la construcción de la oposición género vs. pueblo; (c) criticaremos la interpretación individualista de los derechos de las mujeres desde una apropiación de la Teoría de la Reproducción Social. Resultados y conclusiones. La construcción de la oposición género vs. pueblo se basa en una des-inscripción del feminismo del conjunto de movimientos surgidos al calor de la crisis neoliberal, y en construcción de los derechos de las mujeres como derechos (neo)liberal-individuales. Ante esta operación, es necesario profundizar las perspectivas teóricas (y políticas) que conciben a las demandas de género como parte fundamental de los derechos de la-clase-que-vive-del-trabajo para establecer las condiciones de su reproducción social. La biografía de Solana se ha reconstruido a partir de certificados y documentos originales, recopilando la bibliografía completa, que sobrepasa el centenar de obras. Partiendo de sus escritos se descubre su pensamiento filosófico, histórico, jurídico y teológico. Marcial Solana fue un polígrafo montañés ; Doctor en Filosofía y en Derecho, Alcalde de La Concha de Villaescusa, Diputado a Cortes por Santander, Académico correspondiente de la Real Academia de Ciencias Morales y Políticas, Caballero de la Orden de Malta, miembro del CSIC (...) y de la Sociedad Menéndez Pelayo, Presidente del Centro de Estudios Montañeses, Cronista del Real Valle de Villaescusa y ante todo, hispanista. Su obra más célebre es la "Historia de la Filosofía Española. Época del Renacimiento (Siglo XVI)", donde muestra la inmensa labor intelectual que realizaron los pensadores españoles de ese periodo. Las ideas fundamentales de este autor se pueden resumir así: Defiende con claridad la existencia de una Filosofía Española, que fueron los españoles del renacimiento los que elevaron esa filosofía a su nivel más alto, que estos filósofos cumplieron las condiciones necesarias para merecer ese título (buscaron la verdad, siguieron unos métodos rigurosos de trabajo, avanzaron en el conocimiento y aportaron originalidad en sus obras) Solana's biography has been reconstructed from original certificates and documents. The complete bibliography has been compiled, which exceeds one hundred works. Starting from his writings we have been able to discover his philosophical, historical, legal and theological thought. Marcial Solana was a polygraph, Doctor of Philosophy and Law, Mayor of La Concha de Villaescusa, Deputy to the Cortes for Santander, Corresponding Academician of the Royal Academy of Moral and Political Sciences, Knight of the Order of Malta, member of the CSIC and of the Menéndez Pelayo Society, President of the Center for Mountain Studies, Chronicler of the Real Valle de Villaescusa and, above all, and Hispanic. His most famous work is the "History of Spanish Philosophy. Renaissance period (16th century)", where it shows the immense intellectual work carried out by Spanish thinkers of that period. The fundamental ideas of this author can be summarized as follows: He clearly defends the existence of a Spanish Philosophy, that it was the Spaniards of the Renaissance who raised that philosophy to its highest level, that these philosophers fulfilled the necessary conditions to deserve that title ( they sought the truth, followed rígorous working methods, advanced knowledge and contributed origínality in their works). Despite the growing interest in examining the role of religious beliefs as a guide towards environmental conscious actions, there is still a lack of research informed by an analysis of divine messages. This deficiency includes the extent to which ethics for environmental responsibility are promoted within textual divine messages; types of environmental themes promoted within the text of divine messages; and implications of such religious environmental ethics for business practice. The present study attempts to fill this gap by conducting a (...) thorough content analysis of environmental themes within the divine message of Muslims focusing on their related ethical aspects and business implications. The analysis has revealed 675 verses in 84 chapters throughout all 30 parts of the Qur’an, with environmental content relating to the core components of the natural world, i.e. human beings, water, air, land, plants, animals, and other natural resources. This environmental content and its related ethics are grounded on the belief that humans are vicegerents of God on the earth and their behaviours and actions are motivated by earthly and heavenly rewards. Implications of these findings for different sectors/businesses are also highlighted. (shrink)

The globalizations of capital markets in the last 20 years has led to a historic degree of financial integration in the world. It is clear, however, that globalization is not conducive to a complete homogeneity of financial markets and institutions. Among others, one element of diversity is the importance of the impact of corruption in emerging countries. Corruption decreases the credibility of financial institutions and markets. Scandals and unethical behavior in financial institutions erode confidence in such firms. Relying on neoinstitutional (...) literature, this article focuses on the link between corruption and organizational isomorphism in financial institutions in emerging countries. Therefore, our aim is to examine the institutional reasons for corruption in financial institutions in emerging countries. Our structural equation model is based on empirical research in financial institutions in emerging countries. A questionnaire was administrated to 70 top executives of financial institutions in 18 different emerging countries. (shrink)

Everyday teaching involves emotional and relational irrationalities, and these aspects of pedagogical sensitivity and sense are critical for beginning teachers as they develop their practice. The complex elements of what it means to teach are often impossible to grasp from an instrumental approach to teacher education, which emphasizes subject matter knowledge and practical behavioral know-how. Increased educational standardisation and a new teacher training paradigm in Sweden have resulted in positioning future teachers as responsible only for communicating official school knowledge and (...) assessing their learning process. This narrowed understanding of teachers’ practice requires another perspective of teaching to be articulated. This article explores the internships of beginning teachers from a phenomenological perspective, drawing on storytelling in teacher education as a way to reveal student teachers’ lived experiences. These beginning teachers are learning professional ways of being, which reveal the complexities of teaching, and their accounts have the potential to counter the dominance of neoliberalism in education. In this article, I discuss the question of the hybridity of the religious and the secular through the example of the Slovenian philosopher Slavoj Žižek and his psychoanalytically inspired notion of the undead. The undead is Žižek's rendering of the Freudian death drive, and as the undead is instantiated in the popular culture cliché of the zombies, we need to look no further than to George A. Romero's classic zombie movie Night of the Living Dead from 1968. Thus, this article (...) proceeds in three steps: first, I trace the concept of the death drive from Freud to Žižek, supplemented, for their theological importance, by two contemporary philosophers, Jonathan Lear and Eric Santner. Second, I discuss the zombie in contemporary popular culture, with a focus on Romero's movies, and whether such cinematic representations can function as a kind of cultural critique. In conclusion, I return to the question of theology by showing what Žižek means by theology and contrasting as well as comparing his philosophy to Augustine's anthropology. Despite Žižek's atheistic confession and his dismissal of all pre‐modern philosophy and theology, I show that Augustine's anthropology is structurally similar to Žižek's, thus suggesting that the relationship is more complex than Žižek allows. Both are united in rejecting any superficial and transparent understanding of self, and become, consequently, an example of the ambiguous relationship between religion and secularity in contemporary times. In this article I analyse some of the reasons for a recent, resurgent interest in religion and theology by political philosophers and relate this interest to an inherent instability in modernity itself. In the first part I describe the landscape of current political philosophy with a particular emphasis on radical philosophers. In the second part I describe how the liberal distinction between religion and politics generates a theological instability due to the effective disappearance of the social embodiment of religion within (...) modernity. In the third part I draw some conclusions regarding the challenges the new post-secular condition presents to theology. (shrink)

Taking its cue from the renewed interest in theology among Marxist and politically radical philosophers or thinkers, this study inquires into the reasons for this interest in theology focusing on the British literary theorist Terry Eagleton and the Slovenian philosopher and psychoanalyst Slavoj Žižek as two contemporary prominent Marxist thinkers.

This paper seeks to retrace human nature and transcending the vision of humanity, by identifying, describing and analyzing the Hahnemannian principles and their relevance to anthropology of transcendent philosophy. Using the qualitative data from Hahnemann’s works with special reference to his Organon we found that Hahnemann’s principles are, unquestionably, a philosophical system in its own right. The primary goal of his philosophy, however is not solely speculative, indeed it is a medical philosophy written in brief aphoristic style, aimed more of (...) guidelines at curing suffering human beings, rather than winning adherents to its speculative creed. The main concern of Hahnemann with regard to his medical philosophy is actually the question of suffering human well-being. The answer to this question will provide an indication of the relevant of Hahnemannian principles to anthropology of transcendent philosophy. Thus Hahnemann’s principles cannot be properly understood apart from some grasp of his conception of human nature and philosophy as a whole. Nonetheless his ideas are against the new emergence mainstream thought pattern of modern Europe which in turn spread all over the globe. (shrink)

Previous research showed that accumulations of capital following stationary interest rates are underestimated by human judges. Hyperbolic discounting was suggested as a descriptive and explanatory model for this phenomenon. First, we investigated judged accumulated capital after a period of annual growth and decline. The degree of underestimation increased with accumulated growth and the results supported hyperbolic discounting as a descriptive model on the group level. However, the hyperbolic model did not apply to the data for one third of the participants. (...) Second, we investigated how investment decisions were related to capital accumulation before the investments and to judgments of the possible outcomes of the future investments. To our surprise, the participants’ judgments of expected future accumulated capital did not add predictive power to predictions based on whether there was growth or decline before the investment decision. Unfortunately this strategy leads to suboptimal investment decisions. (shrink)

Drawing upon the work of Gilles Deleuze and Félix Guattari, in particular their writing on Franz Kafka, this article stakes out the ground for a creative critical writing practice beyond the confines of literature. Exploring the notion of writing in relation to affect constellations, what causes one to write, and expressions without content, how one begins to write, the argument put forth is that in rethinking the distinction Deleuze and Guattari tend to make between artistic practice and philosophical thought, a (...) space is opened up for transversal lines that may cross between these fields in practices that are creative and critical and involve what Deleuze and Guattari refer to as aesthetic figures as well as conceptual personae. These practices, it is argued, provide a potential link between aesthetics, on the one hand, and ethics and politics, on the other. (shrink)

Dicho vínculo se llama técnicamente “vocación”, y en la filosofía tardía de Ortega es la única fuente de sentido de la propia vida. La vocación decisiva de Ortega fue la intelectual o filosófica, en el sentido socrático-platónico, no la del “intelectual” como figura que interviene (...) en asuntos públicos, aunque asumiera ese papel con notable intensidad hasta 1932 o 1933. Desde que la Guerra Civil española estalla decidió no ma- nifestarse sobre temas políticos. Uno de los textos que más a fondo reflexiona sobre la condición del intelectual en el doble sentido indicado fue “El intelectual y el otro” (1940), que dialoga dramáticamente con la circunstancia argentina en la que y para la que fue escrito, pero que tuvo repercusiones en el mundo del exilio republi- cano en la América hispana, especialmente en México.
